HOW IT WORKS

 

 

 How does the GCCL perform its duties?

 

Due to the fact that the GCCL (:Global-Court-of-the-Common-Law) is the community that seeks true justice for every human being when requested to do so, it has to perform accordingly. For good reason The Holy Scriptures of the Bible is clearly against judging others.  However, judging must not be confused with arbitration. Judging is a matter of pointless and futile categorizing when man tries to perform this action. This is so, because living men and women lack insight in many aspects, which make a difference when a legal assessment or matters of the law are to be made. Thus, judging only serves the sub-human beings who want to enrich themselves and is of no benefit to the community. To the contrary, it causes even more harm and splits the community. In contrast, arbitration is the solution to bring matters to an amicable conclusion.

 

In principle, the aim of the bible is to make every living man and every living woman perform reasonableness for the benefit of the individual man and/or woman as much as for the community. It is the aim of every member of the community to come to a mutual agreement, neither seeking for loopholes and exploiting them nor to take advantage of any situation. Unfortunately, we all make mistakes and this is where the arbitration comes in, when the involved fail to come to closure.

 

The principle of arbitration was given to man long before the writing of the Bible. It can be found in Genesis and was reiterated about 1500 years later in Matthew 18: 15-17.

 

The provision made in Matthew 18: 15-17 is divided into three steps to achieve the agreement and/or the settlement:

 

The first step is:

 

 

„Moreover, if your brother commits a sin, go and lay it between you and him alone.“

 

Every member of the Common law Court recommends and urges either or all parties involved to the dispute to settle it between them before any arbitration should be sought, because the scriptural arrangement want the settlement by mutual agreement and in private, which is for the peace and the unity in the community:

 

 

„If he listens to you, you have won your brother.“

 

This is the desirable way to achieve the agreement and/or the required settlement.

 

However, if the involved have failed to reach the mutual agreement, because one or all parties refuse to make joinder, then it is time to take the second step:

 

 

„But if he does not listen to you, take along one or two witnesses, so that every affair can be ascertained on the testimony of two or three witnesses.“

 

This is the step, where the court comes in for the purpose of the arbitration. The members of the court will mediate, which is the first duty of the court. They will do their best to help settle the matter by helping the all involved to settle on the even grounds for the mutual and peaceful outcome. If successful, all involved have to conclude the matter without further mentioning anywhere.

 

If the situation arises that the mediation bears no fruit, the third step is initiated:

 

 

  „If he does not listen to them, then speak in front of the congregation.“

 

That’s when the court will deal with the matter if one or both parties so wish. This should be the final step for settling. This is the step, where the court comes in for the purpose of the arbitration. The members of the court will mediate, which is the first duty of the court. They will do their best to help settle the matter by helping all the involved to settle on the even grounds for the mutual and peaceful outcome. If successful, all involved have to conclude the matter without further mentioning anywhere.

 

However, if the party responsible for the damage and/or loss is unwilling to settle the damage and/or loss to the 13 representatives of the Community acting on behalf of the Community, it is necessary to remove the member from the Community and in some cases even a prison sentence will be necessary.

 

The court must base its decisions on the two laws in Matthew 22: 37-40:

 

 

You must love Jah your God with your whole heart and with your whole soul and with your whole mind.

This is the greatest and first commandment.

The second is like this: you must love your neighbour as yourself.

On these two commandments the whole Law hangs.

 

Violating the law of the love is equal to committing the only two crimes anyone can commit:

 

Harm and Loss.

 

The Ten Commandments were written to avoid harm and loss.

 

To establish, what the harm and the loss is, the jury of a minimum of 12 plus 1 members will listen to the matter and find whether the accused has done the harm and/or the loss. The judge first, but also all the other members in the court have to make sure that all the parties understand the issue and the language and he has to make sure that all the biblical principles are followed. The judge is also responsible to protect the accused from false allegations and/or harm that could be attributed to the accused unjustifiably.

 

Once the unanimous verdict is announced by the jury, the court take note of the fact that the community had spoken.

 

The judge has the responsibility to make sure that the damaged party will be duly compensated for the harm and the loss done and/or caused by the wrongdoer. This will be first out of the wrongdoer’s estate.

 

Although the common law court does not want to impose imprisonment, in some instances it is inevitable. Since the court does not want to be abused by the members of the society, it will impose the prison sentences if necessary.

 

Due to the fact that the GCCL is based on the biblical principles, it is the highest court on the earth and when the jurors unanimously come to the verdict, the verdict is final.

 

In the instances where it becomes apparent that the accuser made false statements and/or false accusations, the accuser will be seen by the Court the same way as they where the accused. All settlement will to have to be performed in the same manner as it is, when the accused is found guilty with the difference that in such cases the accuser will turn into the accused = reverse arbitration.
